Offer to conclude a service agreement
Настоящая оферта на заключение договора оказания услуг (далее по тексту «Оферта») является предложением заключить договор на оказание услуг по изготовлению «Родословной» , «Щенячьей Карты», «Сертификата питомника» и/или «Регистрации участия в выставке» (зоотехническом мероприятии), далее по тексту «Договор», на условиях, содержащихся в настоящей оферте.
В соответствии со статьей 438 Гражданского Кодекса Российской Федерации (ГК РФ), безусловным принятием (акцептом) условий настоящей Оферты признается осуществление действий, указанных в п.8.1. настоящей Оферты.
1. Terms and Definitions
1.1.

1.3.
Customer - an individual or legal entity registered on the Service in the manner prescribed by the Rules of the Service.
1.4.

1.5.
Services - services for the production of "Pedigree", "Puppy Card" and "Cattery Certificate", as well as services for their delivery, "Registration of participation in the exhibition" (zootechnical event) provided by the Contractor through the Service.
1.6.
Application - the implementation by the Customer of actions aimed at concluding an Agreement for the provision of services by placing an order for these services directly on the Service.
1.7.
The offer may use terms that are not defined in section 1. In this case, the interpretation of such a term is made in accordance with the text of the Offer. In the absence of an unambiguous interpretation of the term in the text of the Offer, one should be guided by the interpretation of the term defined: first of all, by the legislation of the Russian Federation, and secondly, by the prevailing (generally used) on the Internet.
2. Subject of the contract
2.1.
The Contractor undertakes, at the request of the Customer, to provide him with services for the production of a "Pedigree", "Puppy Card" and "Cattery Certificate" on the basis of an extract from the Register received from the Registrar on entering or changing the data contained in the Register, as well as services for delivering the result of the service to the Customer at the address specified in the application, the term and method of delivery; "Registration of participation in the exhibition" (zootechnical event).
2.2.
The customer undertakes to accept the performed services and pay for them in the manner prescribed by this offer.
3. Placement and order of execution of the Application
3.1.
The Customer, registered on the Service, places an Application for the Services, in which he indicates the name, telephone number and e-mail address for feedback.
3.2.
The Contractor, on the basis of the Application, generates an invoice for payment and, after receiving payment from the Customer, confirms the acceptance of the Customer's Application placed on the Service for execution in order to provide services under the Agreement.
3.3.
After the Contractor has performed the actions specified in 3.2. of the Agreement, the Parties acknowledge that the Contractor and the Customer have reached an agreement on the essential conditions for the provision of services for the relevant Application, such Application becomes mandatory for the provision of the Contractor's services and becomes an integral part of the Agreement.
3.4.
In order to enter or change the information contained in the Register, the Customer, at the request of the Contractor, provides all the necessary data and supporting documents for transfer to the Registrar. The Contractor shall not be liable if, as a result of incompleteness and / or inaccuracy of the data provided by the Customer, the Registrar refused to register changes in the Register and / or receive an extract from it.
3.5.
In case of receiving a positive response from the Registrar and confirmation of the registration of information on the Customer's Application in the Register, the Contractor within seven days produces the "Pedigree", "Puppy Card", "Cattery Certificate" on the appropriate forms certified by the Registrar and on his behalf; "Registration of participation in the exhibition" (zootechnical event).
3.6.
Within seven days, the Contractor sends the result to the address and delivery method specified in the Customer's Application.
4. Rights and obligations of the parties
4.1.
The Contractor undertakes:
- Provide services for the production of "Pedigree", "Puppy Card" and "Cattery Certificate", as well as services for the delivery and "Registration of participation in the exhibition" (zootechnical event) in strict accordance with each relevant Application from the Customer in accordance with the terms of the Agreement, with with proper quality and in full, in compliance with all deadlines.
- To provide assistance in correcting incomplete and inaccurate data that caused the Registrar's refusal to register the changes made to the Register.
4.2.
The performer has the right:
- Refuse to execute the Agreement in case of non-compliance by the Customer with its obligations, full or partial failure to fulfill the terms of the Agreement.
- Request the necessary documents from the Customer, conduct their preliminary check and, if necessary, demand the correction of incomplete or inaccurate information specified in them.
4.3.
The customer undertakes:
- Timely provide the required data and documents at the request of the Contractor.
- Accept the rendered Services if the result fully meets the requirements of the Customer. The act of acceptance of the rendered Services is the "Pedigree", "Puppy Card" or "Cattery Certificate" received by the Customer, "Registration of participation in the exhibition" (zootechnical event). In the event that within seven days, after receiving them, the Customer did not make any claims, then the Services are considered to be performed in full.
4.4.
The customer has the right:
- Be interested in the progress of the Services.
- Refuse to execute the Agreement in case of non-compliance by the Contractor with its obligations or failure to fulfill the terms of the Agreement.
5. Cost of services and payment procedure
5.1.
For the services rendered under the Contract, the Customer pays a fee to the Contractor.
5.2.
The amount of remuneration for the services for the production of "Pedigree", "Puppy Card", "Cattery Certificate" and "Registration of participation in the exhibition" (zootechnical event) is indicated on the Service, the amount of payment for delivery services is calculated separately after consideration of the Application, depending on the selected by the customer of the shipping method.
5.3.
Payment for services is carried out by making an advance payment on the Service, after which the Agreement is considered concluded.
5.4.
In relation to any monetary obligations of the Parties under the Agreement, the legal interest provided for in Article 317.1 of the Civil Code of the Russian Federation (interest on the amount of debt for the period of use of funds) is not accrued or paid by the Parties.
6. Responsibility of the parties
6.1.
The parties are responsible in accordance with the current legislation of the Russian Federation.
6.2.
Neither Party shall be liable for full or partial failure to perform any of its obligations if the failure is the result of such circumstances as flood, fire, earthquake, other natural disasters, war or hostilities and other force majeure circumstances that arose after the conclusion of the Agreement B in the event of force majeure circumstances for more than 3 (Three) months, any Party has the right to unilaterally refuse to fulfill its obligations under the Agreement (terminate the Agreement).
6.3.
Disputes and disagreements that may arise during the execution of this Agreement will, if possible, be resolved through negotiations between the Parties.
6.4.
If it is impossible to resolve disputes between the Parties to the Agreement through negotiations, they must be resolved in a court established by the current procedural legislation of the Russian Federation.
7. Applicable right
7.1.
This Agreement, the relations between the Customer and the Recruiter that arose during the execution of the Agreement and are not regulated by the Agreement, are regulated in accordance with the current legislation of the Russian Federation.
7.2.
This agreement is a contract for the provision of services for a fee and is governed by the provisions of Chapter 39 "Paid Services" of the Civil Code of the Russian Federation.
8. Conclusion and validity of the Agreement
8.1.
The Agreement is considered concluded between the Parties and enters into force for the Parties at the moment the Customer performs actions aimed at fulfilling the agreement, namely: making an advance payment for the Services. The Customer has the right to change the terms of the agreement at any time by posting on the Website the version of the agreement with amendments and / or additions - the latest version of the agreement, which will be applied in the relationship of the parties.
8.2.
By entering into the Agreement, the Parties guarantee that they have the necessary legal and legal capacity to conclude and execute the Agreement in accordance with the legislation applicable to the Agreement.
